In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter, “RGPD”) and the Organic Law 3/2018, of December 5, of Personal Data Protection and guarantee of digital rights (hereinafter, “LOPDGDD”) informs you that through the following privacy and data protection policy (hereinafter, the “Policy”) regulates the processing of personal data provided by users (hereinafter, “User” or “Users”) in the form of the Vision Painter application (hereinafter, the “Form”) owned by SINGULAR PEOPLE EUROPE, S. L.U. (hereinafter, “SNGULAR”).

PRIVACY POLICY

At VisionPainter (“we”, “our” or “us”), we are committed to respecting and protecting your privacy. This Privacy Policy describes that our Apple Vision Pro application (the “Application”) does not collect, store or process any personal data of its users.

Our Application is expressly designed to function without the need to collect any personal information.

USE OF DATA

As a general rule, and for your use, the Application does not collect any personal information, there is no use, processing or analysis of data related to personal information.

In any case, the Application makes available to users a Form where they can contact the Responsible Parties. This form will only collect, among others, identifiable data such as names, email addresses, physical addresses, geolocation data or any other personally identifiable information (PII).

The User or Users are considered to be both the persons who access the Form and the persons who, in addition to accessing the Form, provide their personal data to the Data Controller.

You are hereby informed that SNGULAR fully complies with current legislation on the protection of personal data and with the confidentiality requirements of its activity.

WHO IS RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA?

SINGULAR PEOPLE EUROPE, S.L.U., with registered office at Calle Labastida 1, 28034 Madrid, registered in the Mercantile Registry of Madrid, Volume 41.361, folio 140, Section 8, sheet number M-733.086, is responsible for the processing of the User’s personal data, and informs you that these data will be treated in accordance with the provisions of the RGPD and the LOPDGDDD.

WHAT DO WE PROCESS YOUR PERSONAL DATA FOR AND WHY DO WE DO IT?

Your personal data, obtained from the Form, will be treated confidentially to respond to queries or any type of request that is made by the User through any of the forms of contact that are made available (for the legitimate interest of the responsible, art. 6.1.f RGPD).

TO WHOM DO WE PROVIDE YOUR PERSONAL DATA?

SNGULAR does not disclose personal data to third parties without the express consent of the owners, which must be granted on each occasion, being only disclosed for the purpose expressed and always with the consent of the User.

ARE INTERNATIONAL DATA TRANSFERS CARRIED OUT?

SNGULAR does not transfer data internationally.

FOR HOW LONG IS YOUR PERSONAL DATA KEPT?

SNGULAR only retains personal data for the time strictly necessary to fulfill the purpose(s) for which the data were collected, or to comply with legal obligations under the various regulations.

WHAT ARE YOUR RIGHTS?

The rights that assist the User are:

  1. Right to withdraw consent at any time.
  2. Right of access, rectification, portability and deletion of their data, and to limit or oppose its processing.
  3. Right to file a complaint with the supervisory authority (www.aepd.es) if he/she considers that the processing does not comply with the regulations in force.

WHAT SECURITY MEASURES AND LEVELS OF SECURITY HAVE BEEN ADOPTED?

SNGULAR has adopted the necessary measures to maintain the required level of security, according to the nature of the personal data and the circumstances of the processing, in order to avoid as far as possible and always according to the state of the art, its alteration, loss, processing or unauthorized access.

In accordance with the provisions of current legislation on personal data protection, SNGULAR complies with all the provisions of the RGPD and the LOPDGDD for the processing of personal data under its responsibility, as well as with the principles described in Article 5 of the RGPD, whereby the data are processed lawfully, fairly and transparently in relation to the data subject, and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

SNGULAR guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the RGPD and the LOPDGDD in order to protect the rights and freedoms of Users and has provided them with the appropriate information so that they can exercise them.

CONFIDENTIALITY AND PROFESSIONAL SECRECY

The data collected from all private communications between SNGULAR and the Users shall be treated with absolute confidentiality, and SNGULAR undertakes to maintain the secrecy of personal data, its duty to store them and adopt all necessary measures to prevent their alteration, loss, unauthorized processing or access in accordance with the provisions of the applicable regulations.

Additionally, all the information that the parties exchange between themselves, that which they agree to be of such nature, or that which simply deals with the content of such information, shall be considered confidential information. The visualization of data through the Internet does not imply direct access to the same without the express consent of its owner for each occasion. Users are advised not to provide any identification data, password or reference number that SNGULAR may provide to any third party. Likewise, to ensure that the protection of professional secrecy between SNGULAR and the User is maintained in all communications, Users must not disclose confidential information to third parties.

CHANGES IN DATA SECURITY AND PROTECTION

SNGULAR reserves the right to modify its security and data protection policy in order to adapt its content to new legislative or jurisprudential developments, as well as those that may arise from existing standard codes on the subject, due to strategic corporate decisions, with effect from the date of publication of said change in the application.
